Tata Steel Nederland faces criminal prosecution for alleged environmental violations

Tata Steel Nederland faces criminal prosecution for alleged environmental violations
The Dutch Public Prosecutor's Office (OM) has announced that it has decided to bring Tata Steel Nederland to justice, suspecting the company of committing several criminal offenses, including deliberate and illegal release of harmful substances into the air, which could have adverse consequences for public health. The company is also suspected of violating its duty of care by conducting insufficient maintenance, operating without the necessary permits, and failing to report several incidents involving raw coke.

A criminal investigation was launched following a complaint filed by a lawyer on behalf of more than 800 applicants. The investigation focused on Tata Steel's steel production process and the operation of its coke oven gas plants. After reviewing the case file, the prosecutor's office concluded that there was sufficient evidence to bring criminal charges against the company.

A separate investigation into individual responsibility continues

In addition to the prosecution of Tata Steel as a legal entity, the State Prosecutor's Office is continuing a separate investigation into whether those in senior positions may be personally responsible.

The decision to summon the company at this stage was made to maintain progress in the criminal proceedings while the investigation into potentially implicated individuals continues. The first preliminary hearing is scheduled for November 20, 2026 at the Amsterdam District Court.
