The ETS regulation establishing rules on the carbon market comes into force in Turkey

The ETS regulation establishing rules on the carbon market comes into force in Turkey

The Turkish Regulation on the Emission Trading System in Turkey, prepared by the Turkish Ministry of Environment, Urbanization and Climate Change, establishes procedures and principles governing the monitoring of greenhouse gas emissions, reporting and verification, as well as the implementation of the emission trading system in the country. The resolution was published in the Official Gazette and entered into force on August 27, 2026.

According to current legislation, one surcharge represents the right to emit 1 million tons of CO₂ equivalent, while the ETS cap will include allowances allocated free of charge and those offered for sale on the primary market. The maximum emission level will be determined based on the emission intensity and announced in the National Emission Allocation Plan.

Installations of categories B and C that will participate in the ETS in Турции

The installations will be divided into three categories according to their estimated annual emissions. Installations emitting up to 50,000 tons of CO₂ equivalent will be classified as category A, installations emitting more than 50,000 tons of co₂ equivalent and up to 500,000 tons of co₂ equivalent will be classified as category B, and installations emitting more than 500,000 tons of co₂ equivalent will be classified as category C. The ETS for Turkey applies to Category B and Category C facilities that carry out the activities specified in the rules. Category A installations will still be subject to monitoring, reporting and verification requirements, but they will not participate in ETS.

Operators covered by the system will have to obtain a permit for greenhouse gas emissions from the Office of Climate Change. Permits will be valid for five years, and renewal applications must be submitted at least six months before their expiration date. Operators subject to the ETS must obtain their permits within three months. years after the entry into force of the Climate Law, although it is believed that they will have a permit during this period on a one-time basis.

Free benefits will be determined using the control показателей

Free benefits The cost can be determined using a benchmarking methodology at the substation level based on product performance, measured heat, fuel, and manufacturing process. The amount allocated for free will be calculated using the appropriate base value, the free allocation coefficient, the industry activity coefficient, and the confirmed activity level. If necessary, an intersectoral correction factor can also be applied.

Operators will have to waive permits corresponding to the confirmed emissions of each installation through the registration system by the last business day of November in the relevant compliance year. The Regulation also provides for flexible mechanisms to allow reserves to be retained for future years and to be borrowed from future periods.

An additional reserve fund and a stabilization mechanism have been introduced. рынка

Enterprises facing a shortage of reserve funds can, subject to certain conditions, gain access to an additional reserve of up to 10 percent of the ETS limit. The minimum price for quotas from this reserve will be set at 50 percent above the weighted average price on the primary market or the weighted average price on the secondary spot market for the previous three months.

Discounts will be sold on the primary market according to the auction schedule, while trading on the secondary market will be carried out on an ongoing basis. To maintain price stability, a market stability reserve will also be created, taking into account the prices of permitted goods and the number of permitted goods in circulation. The issuance, holding, transfer, refund, cancellation and cancellation of reserves will be carried out through a registration system operated by the Istanbul Energy Exchange, with separate accounts created for each установки.

Internal carbon standards can be used to comply with the ETS. кредиты

The regulation system provides for the use of carbon credits obtained as a result of the implementation of projects in Turkey to fulfill repayment obligations in the amount determined by the carbon market of Turkey. In addition, Turkey's ETS could eventually be linked to emissions trading systems in other countries or regions through measures including mutual recognition of permits.

Operators will be required to submit their greenhouse gas emissions and activity levels for the previous calendar year by April 30 times a year after verification by an accredited verification body. The relevant data and records must be preserved for at least 10 years.

The Regulations provide for penalties for non-compliance. требований

The Regulations establish administrative fines. for violations related to emissions reporting and permit requirements. Penalties for failure to submit confirmed emission reports range from 627,450 Turkish liras (US$13,000) for Category A installations to 6.27 million Turkish liras (US$130,258) for Category C installations emitting more than 2 million tons of CO₂ equivalent per year. These penalties will be doubled for operators subject to the ETS. Operating without the required emission permit can result in penalties of up to 12.55 million Turkish liras (US$ 260,725), depending on the amount of emissions produced by the installation..

To begin the pilot period of ETS implementation in Турции

The ETS in Turkey will initially operate during a pilot implementation period, the scope, duration and principles of which will be determined by the Carbon Market Council.. Operators participating in the pilot period will have to submit their initial monitoring methodology plans electronically within two months of the entry into force of the regulation, although this period may be extended to six months. The first implementation period following the pilot phase will consist of two sub-periods, with the control values for the first sub-period announced in The national plan for the allocation of funds after the submission of relevant reports on проверке.

The new regulation also repeals Turkey's 2014 Regulation on monitoring greenhouse gas emissions, while references to the previous regulation are considered relevant to the new system.
