Huge quota for the removal of scrap metal can violate the Rules of the WTO

The Government of Ukraine approved by Decree No. 388 of May 3 to 2012 by a quota for export of scrap metal in the amount of 900,000 tons. The customs clearance of scrap metal exports will be carried out on a special registration card of a foreign economic contract, which is instructed to develop the Ministry of Economic Development over the next two months.

The surprise of experts caused a large amount of quota. According to the State Statistics Service of Ukraine, in 2011, 801,700 tons of scrap metal in the amount of $ 320.2 million were taken out of the country. "It would be logical to set a quota in the amount of about 100,000 tons, which would give an additional 700,000 tons of Ukrainian missile defense systems. The decision to install such a high level of scrap metal is not clear." - Says analyst IK Evex Capital Ivan Dzvinka.

The conditions for the annexation of Ukraine to the WTO implied a decrease by 3% of the annual quota for the export of scrap metal from the country. Back in December 2010, the Verkhovna Rada of Ukraine adopted the Law "On the introduction of some amendments to the laws on operations with scrap metal" which transferred to three years a planned reduction in trade duties for the export of scrap metal from 24% to 21%. Thus, the decrease was postponed to 2014.

However, these steps of Ukraine did not lead to the appeal of interested countries to the WTO bodies by resolving disputes - the conflict was limited to the protest letter of the European Commission.

“Considering that this is not our first violation of the scrap metal, it will be much more difficult to prove the validity of the introduction of a new restriction. In any case, we are waiting for non -earth embassies, and if foreign trains consider these measures painful for themselves, about and appeals to the WTO organs,” Dovgan Dovgan's managing partner of the law of Dovgan and partners.
