The requirements for the issuance of a construction license were adjusted in 2016. However, they did not lead to any special changes. A developer - a legal entity - is issued a license for 3 years (for the first time) and for 5 years each repeated application. An individual needs a building permit on his site if the object is characterized by capital.
The document differs according to the categories of construction complexity
Depending on the complexity of the structure, the construction license is divided into 5 categories. The list of requirements depends on each of them. This parameter is determined by the following criteria: residential /non-residential building, how many people can be in it constantly /periodically, the level of danger inside and outside the facility.
List of categories:
I - outbuilding where people are not permanently located (barn, garage),
II - a small capital building, which can accommodate up to 50 people (private house, office, cottage),
III - a capital object with the expectation of staying in it 50/300 people (public organization, multi-storey building),
IV - the house is designed for a stay of 300/500 people. and /or the object poses a danger to 10 thousand people. and more (shopping centers, educational institutions, train stations, concert halls),
V - the building can accommodate 400 /more than 1000 people. and /or the structure poses a high danger to 50 thousand people. and more.
The determination and justification of the assessment of the category of complexity is carried out by the design firm, which is entrusted with drawing up a plan for the future construction. For this, the document of the State Standard is used: DSTU-N B V.1.2-16: 2013.
What does a building license look like?
The document is a state form with protective equipment. A detailed list of works issued by the Ministry of Construction is attached to it. It should be said that this list of types of work is invalid without a permitting license.
Obtaining a license is possible when the developer has the following documents:
- confirm the right to build (decision, contract, agreement),
- conclusions of the non-departmental examination.
The Licensing Commission meets at SACI (State Architectural and Construction Inspection). After receiving the document, the developer must come to Gosgortekhnadzor (for permission from Labor Protection).
In conclusion
Since 2016, the licensing conditions in Ukraine have been changing. For example, it has become mandatory to obtain the conclusions of the on-site examination. Also, the Ministry of Regional Development of Ukraine initiates a reduction in the terms for which construction licenses will be issued. That is why it is better to clarify the conditions for issuing this document before preparing the package.
