Government officials will have to declare spending in a new way

In 2013, new rules were introduced in Ukraine, which should be adhered to when civil servants declare their income and expenses for the past year. This is stated in the message of the press service of the Cabinet of Ministers of Ukraine.

The innovations, first of all, relate to the requirements for the reflection of more detailed information in the declaration. In addition, from January 1, 2014, new rules for declaring expenses came into force, which must be applied in the declaration for reporting periods starting from this year.

We are talking about improving the mechanism for declaring property, income, expenses and liabilities of a financial nature for persons authorized to perform the functions of the state or local government, and officials of legal entities of public law. This is provided for by the Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine on the Implementation of State Anti-Corruption Policy" dated May 14, 2013 No. 224 - VII, which, apart from certain provisions, entered into force on June 9, 2013.

By submitting the Declaration in 2013, the declaring subject is obliged to indicate the date of birth of family members, as well as the full name of banks, other financial institutions, organizations, enterprises, organizations, etc., with which the declaring subject or his family members have relevant relations.

In addition, the Law expanded the range of subjects of declaration at the expense of persons who are released or otherwise terminate activities related to the performance of the functions of the state or local government, submit a declaration of property, income, expenses and liabilities of a financial nature for the period that is not covered by previously submitted declarations. ...

Also, the subjects of declaration who have vacated or otherwise ceased activities related to the performance of the functions of the state or local self-government are obliged, within one year, to submit at their last place of work (service) a declaration of property, income, expenses and liabilities of a financial nature for the last year in the form and in the manner determined by this Law.

At the same time, the amount of expenses of the subject of declaring for the acquisition of ownership /lease or other right to use real estate and vehicles, as well as the amount of funds invested in the reporting year by the subject of declaring in bank accounts, the nominal value of securities acquired by him in the reporting year, the size contributions made by him in the reporting year to the authorized (pooled) capital of the company, enterprise, organization, expenses of the declaring subject and his family members for the maintenance of immovable property and vehicles, other expenses of the declaring subject are noted if a one-time expense (contribution /contribution) for each of these items in the reporting year is equal to or exceeds 80 thousand hryvnia.

At the same time, since in accordance with Article 58 of the Constitution of Ukraine, laws do not have a retroactive effect in time, this rule will apply to filling out declarations for reporting periods starting from 2014, and therefore the information on expenses in the 2013 declaration is filled in in accordance with the rules, in the reporting year.
